The Indictment Exercise
. This will entail reading a controversial legal document and analyzing its content. This examination of an indictment is good practice in terms of connecting the legal document with the legal requirements to prove certain offenses. Specifically, we will look at what the language of a charge and what the elements of a particular charge actually are. For instance, if one of the charges is relating to extortion, we will look at the law (statute)) and evaluate what actually needs to be proven and what the consequences of a conviction might be.
. Please read it over quickly once....it will seem like it is written in a foreign language. Look closely at only one Count contained in this indictment. Indictments are the result of a grand jury's evaluation of charges (either charges filed after you have been arrested or charges that will be filed leading to someone’s arrest).
The grand jury serves as a filter.
A grand jury evaluates the charges placed against someone and either votes to pass an indictment which says that the grand jury has reason to believe a crime may have been committed and the case is then set up to go to trial (expression for this is often "bound over for trial"; or, in very rare instances, the charges are "no billed" and no indictment is approved.
For the count of the indictment you choose, determine what the elements of the charge consist of and be prepared to discuss it.
