Bad Boy and his bad ideas
Bad Boy (BB) goes to the home of Dirty Don (DD). While there, DD starts talking about his financial troubles. BB comments,
“You know, if you just got a couple of simple ingredients, we could make some real money.”
DD replied, “You mean drugs? Well, I am o.k. with that. How would we make the drugs?”
BB replies, “I don’t know…..look on the Internet….you can find everything there.
Here, use my laptop.”
DD looks up a recipe for methamphetamine on the web.
BB is arrested later that evening. BB is charged with solicitation to manufacture narcotics, aiding and abetting the
manufacture of narcotics, conspiracy to manufacture narcotics and attempted manufacture of narcotics.
1. Explain the elements of each of the crimes; and
1a. Analyze which of the actions of BB fall within the charges and
1b. Explain which elements of the charges are NOT present in BB’s actions.
Road Trip to Miami, Florida
DD has made methamphetamine using the recipe he found on the web. He calls his friend Awesome Amy (AA) and she agrees
to drive him to Florida where the price of meth is high. On the way to Miami, Florida, he tells AA why he needs to go to
Florida and that he has the narcotics with him.
.AA drops DD off on a corner in Miami and leaves.
At a meeting to sell the drugs DD is threatened by the drug buyers in the following manner: they each hold back their
jackets to reveal they each have handguns. and one comments, “Hey DD….this ain’t your day.
You ain’t getting paid and we get the drugs….hand em over or do I have to show you what this 9 millimeter
automatic can do?”
DD reaches into his pocket as though he is handing over the drugs and shoots both the “would be” robbers
dead with a pistol he kept.
2. Analyze the self-defense issues in this case using the law in Florida and the law in Pennsylvania (use the self-defense
instructions in the course website for Pa). What are the elements of self-defense in each state and what would be the major
issues in a prosecution of DD for the murder of these two people? Be sure to explain your answer in detail.
AA to the rescue
DD calls AA on her cell phone and tells her he needs a little help. She picks him up at the scene of the shooting. As
they drive from the scene someone stands on the edge of the roadway and shakes his fist and angrily yells, “Hey,
he shot my friends!” This individual (Pedestrian #1) reaches threateningly into his coat. Amy swerves to the right
and strikes him, killing him.
AA speeds up and is eventually exceeding 70 miles per hour. The speed limit is 50 miles per hour and on a curve the car
slides off the road and kills Pedestrian #2.
Arriving at a motel to get a room, they learn that the motel has no rooms. They meet a young couple, Mara and Newt, who
agree to share their room. While in the room, DD shows everyone his gun and practices his “quick draw.”
As he puts the gun back in the holster it fires unintentionally and strikes Mara, killing her instantly.
Newt, realizing Mara is dead, leaps on DD and struggles with DD trying to get the gun from him. DD gets the gun away
from Newt and fires it killing Newt.
3. Evaluate the homicide of Pedestrian 1, Pedestrian 2, Mara and Newt. Be sure to explain the level of homicide and
the elements and the issues of each. Be sure to explain what the major issues would be in the prosecution of AA and DD for
these homicides.
